Recorrido breve por su obra, con motivo de su reciente fallecimiento.

Cuando la profesora y directora de la revista Problema, Sandra Gómora Juárez, nos propuso a la profesora Marina Gascón Abellán y a mí llevar a cabo una discusión acerca de las teorías y doctrinas del precedente en nuestro contexto, no me pude sentir más contento. Al indudable y reconocido prestigio de la revista Problema se sumó la posibilidad de volver a trabajar con la profesora Marina Gascón y hacerlo por primera vez con Sandra Gómora. Además, (...) surgió la oportunidad de volver a discutir con viejos amigos —como Flavia Carbonell, Fabio Pulido, Silvia Zorzetto— sobre cuestiones relativas al precedente, y poder contrastar opiniones con otros nuevos, como Rodrigo Camarena. En esta ocasión, me corresponde comentar, en particular, los trabajos del profesor Fabio Pulido Ortiz y de la profesora Silvia Zorzetto. Ambos trabajos son de una indudable calidad. El del profesor Pulido Ortiz, de la Universidad de La Sabana de Colombia, es un trabajo de finura y sutileza analítica que entra a discutir, al calor de la teoría del precedente, algunos problemas fundamentales de la teoría del derecho. La profesora Silvia Zorzetto, de la Università Statale di Milano, ha llevado a cabo un reconocimiento analítico y metalingüístico de la práctica de los precedentes en Italia, con especial atención a le Sezioni Unite Civili della Corte di Cassazione italiana, de incalculable valor. Ello no sólo por el valor que pueda tener para el estudio de la cultura jurídica (interna) italiana, sino porque su análisis puede ser, al menos en parte, generalizado para dar cuenta de cómo son usados los precedentes en los ordenamientos de civil law. It filled me with pleasure to be asked by Problema editor-in-chief Sandra Gómora Juárez to lead a discussion on the theories and doctrine on precedent in our context alongside Prof. Marina Gascón Abellán. Besides the undeniable and recognized prestige of the Problema journal, there was also the possibility of working with Prof. Marina Gascón again and with Sandra Gómora for the first time. It was also an opportunity to discuss issues regarding precedent with old friends (...) like Flavia Carbonell, Fabio Pulido and Silvia Zorzetto, and exchange opinions with new ones like Rodrigo Camarena. On this occasion, I would like to comment specifically on the works of Prof. Fabio Pulido Ortiz and Prof. Silvia Zorzetto, both of which are of unquestionable quality. The article by Prof. Pulido Ortiz of the Universidad de la Sabana in Colombia is a work of analytical finesse and subtlety that discusses some fundamental problems of legal theory from the standpoint of the theory of precedent. Prof. Silvia Zorzetto from Università Statale di Milano has conducted an analytical and metalinguistic survey of the use of precedents in Italy, particularly at the Italian Sezioni Unite Civili della Corte di Cassazione. This work is priceless not only in terms of its value as a study of (internal) Italian legal culture, but also because the analysis can be generalized, at least in part, to explain how precedents are used in civil law systems. Empoderar el inglés por medio del sistema dual y las diferentes especialidades, es una tarea que el área de idiomas ha tratado por mucho tiempo de llevar a cabo por medio de la inserción del inglés técnico al programa de inglés general que el MCCEMS oferta, aún sin éxito. Es por eso por lo que se elabora esta propuesta de reajuste para la materia de inglés, en cuanto a dosificación de temas (reestructuración al MCCEMS), en cuanto a número de horas (...) clase (derivado del acuerdo 653, se pretende un incremento de horas para el sexto semestre y por lo menos 1 para los semestres que ya cuentan con la materia), en cuanto a contenidos específicos (inserción del vocabulario técnico y desenvolvimiento en las áreas de especialidad con el uso del idioma), lo que es el saber hacer con el inglés dentro su entorno trabajando más a profundidad el trabajo por competencias. Para lograr dicho objetivo se requiere a docentes de inglés especializados en las distintas áreas que se ofertan, en los distintos centros educativos de los subsistemas de EMS, así mismo que brinden mayor tiempo dentro del aula para garantizar que dicho aprendizaje sea exitoso, iniciando primeramente con los alumnos de sistema Dual por estar más en contacto con las unidades económicas y en un segundo paso al resto de los alumnos. Todo esto para tener mayor número de egresados certificados en el idioma con dominio de su área de especialidad. (shrink)

The studies here examine evil in Asian thought, in Western theory, in the cosmic order, in human psychology, and in social practice. Insights are added to the philosophical discussions from religion, culture, history, law, technology, and literature.

In this paper I pursue an avenue of argument implicit in Patristic thinkers — such as Tertullian and Athanasius — and explicit in the thomistic and scholastic tradition. I argue that there is an ontological unity to the world, and that this unity calls for an explanation in terms of a transcendent cause, traditionally identified with God.

Resumen. La presente investigación busca diseñar un modelo estratégico de formación de servidores públicos que propicie el crecimiento personal y profesional, encaminado al servicio civil de carrera. Apoyándose en criterios, conceptos y estrategias propios de Administración del Capital Humano, y Aprendizaje Organizacional aplicándolas al contexto de la Administración Pública Estatal. Para alcanzar este propósito se realizó un diagnóstico con beneficios claros, que dan la oportunidad de pensar y dialogar sobre la estrategia, los objetivos, las personas y el futuro de la (...) Administración Pública Estatal Sinaloense desde una perspectiva del conocimiento. El trabajo de campo se realizó con personal que presta sus servicios en entidades y dependencias administrativas públicas pertenecientes al Poder Ejecutivo del Gobierno del Estado de Sinaloa. A través de un cuestionario, con una muestra de 400 individuos. Se han obtenido 29 indicadores cuyos valores reflejan donde reside el valor del Capital Humano. Así como una puntuación total alcanzada de 104 puntos, advirtiéndose que en el área de gestión del conocimiento, es necesario hacer “algo” para que esta administración, sea considerada como una organización que aprende en toda regla y que realiza una gestión del conocimiento de forma óptima y eficaz. The present research pretends to design a strategic model to train public servants to help to develop both professional and personal growth, headed to civil service as a profession. Based on criteria, concepts and strategies from Human Capital Administration and Organizational Learning, applying these to the State Public Administration’s context. To achieve this goal, a diagnose took place with clear benefits, that give, to us all, the chance to think and discuss about strategies, objectives, people and future of the Sinaloa State Public Administration from a knowledge perspective. Fieldworkwas done by personnel that serve in administrative public entities and organizations that are part of the Executive Power of the Sinaloa State Government. Through a questionnaire, with a sample of 400 individuals, there was a result of 29 indicators, and its values reflect where the importance of the Executive Power of the Sinaloa State Government lies, as well as a reached total score of 104 points. Noting that in the knowledge promotion area it is necessary to do something so this administration would be considered an organization that learns with every rule and performs a knowledge management in an optimum and efficient way. Since approval of the EU General Data Protection Regulation (GDPR) in 2016, it has been widely and repeatedly claimed that the GDPR will legally mandate a ‘right to explanation’ of all decisions made by automated or artificially intelligent algorithmic systems. This right to explanation is viewed as an ideal mechanism to enhance the accountability and transparency of automated decision-making. However, there are several reasons to doubt both the legal existence and the feasibility of such a right. In contrast to the (...) right to explanation of specific automated decisions claimed elsewhere, the GDPR only mandates that data subjects receive meaningful, but properly limited, information (Articles 13-15) about the logic involved, as well as the significance and the envisaged consequences of automated decision-making systems, what we term a ‘right to be informed’. Further, the ambiguity and limited scope of the ‘right not to be subject to automated decision-making’ contained in Article 22 (from which the alleged ‘right to explanation’ stems) raises questions over the protection actually afforded to data subjects. These problems show that the GDPR lacks precise language as well as explicit and well-defined rights and safeguards against automated decision-making, and therefore runs the risk of being toothless. We propose a number of legislative and policy steps that, if taken, may improve the transparency and accountability of automated decision-making when the GDPR comes into force in 2018. (shrink)

To create fair and accountable AI and robotics, we need precise regulation and better methods to certify, explain, and audit inscrutable systems.

The world is complex, but acknowledging its complexity requires an appreciation for the many roles context plays in shaping natural phenomena. In _Unsimple Truths, _Sandra Mitchell argues that the long-standing scientific and philosophical deference to reductive explanations founded on simple universal laws, linear causal models, and predict-and-act strategies fails to accommodate the kinds of knowledge that many contemporary sciences are providing about the world. She advocates, instead, for a new understanding that represents the rich, variegated, interdependent fabric of many levels (...) and kinds of explanation that are integrated with one another to ground effective prediction and action. Mitchell draws from diverse fields including psychiatry, social insect biology, and studies of climate change to defend “integrative pluralism”—a theory of scientific practices that makes sense of how many natural and social sciences represent the multi-level, multi-component, dynamic structures they study. She explains how we must, in light of the now-acknowledged complexity and contingency of biological and social systems, revise how we conceptualize the world, how we investigate the world, and how we act in the world. Ultimately _Unsimple Truths _argues that the very idea of what should count as legitimate science itself should change. (shrink)

A despeito das “autocríticas protocolares”, os textos expressam a crítica interdita pelo dogmatismo e o sectarismo característicos do período e irão repercutir a preocupação do autor de que a Estética e Para uma Ontologia do Ser Social, fossem consideradas como sua contribuição à urgência da construção de um projeto de renovação e renascimento do marxismo.

The pandemic has exposed the costs of job and income losses. Emergency cash transfers can mitigate the worst immediate effects on people who lack access to safety nets. This research note provides estimates for a potential Temporary Basic Income for poor and near-poor people across 132 developing countries, as well as the minimum cost of income support sufficient to mitigate the pandemic-induced poverty increase. The total monthly cost of the TBI ranges 0.27–0.63% of developing countries’ combined GDP, depending on the (...) choice: top-ups on each country’s average incomes up to a vulnerability threshold; transfers based on each country’s median standard of living; or uniform transfers. This note argues that some form of TBI is within reach and can inform a larger conversation about how to build comprehensive social protection systems that make the poor and near-poor more resilient to economic downturns in the future. Alumnos con discapacidad: modelo de inclusión de la Universidad Federal de San Carlos Resumen: El objetivo fue describir cómo funciona el programa de inclusión para alumnos con discapacidad en la Universidad Federal de San Carlos, en Brasil. Es una investigación cualitativa con análisis del discurso de cuatro entrevistas semiestructuradas con alumnos con discapacidad, investigadores especialistas y gestores. Los principales resultados muestran que no es suficiente trabajar sobre los ejes de atención a estos estudiantes sino se analizan y evalúan las funciones (...) de los actores involucrados en el proceso de inclusión. Es necesaria una estructura que promueva cambios culturales en la comunidad universitaria, de otro modo, las barreras actitudinales siguen siendo uno de los principales límites para estos alumnos. Trata-se de uma pesquisa qualitativa com base na análise do discurso de quatro entrevistas semiestruturadas com alunos com deficiência, pesquisadores especializados e gestores. Os resultados centrais mostram que não é suficiente trabalhar sobre os eixos principais de atenção a estes alunos, que deve-se analisar e avaliar as funções dos atores envolvidos no processo de inclusão, e é preciso uma estrutura que motive uma mudança cultural na comunidade universitária, caso contrário, as barreiras atitudinais continuam sendo limites principais para estes alunos. Students with disabilities: inclusion model of Federal University of São Carlos Abstract: The objective of the study is to describe the inclusion program for students with disability in the Federal University of São Carlos, in Brazil. A qualitative study based on discourse analysis of four semi-structured interviews with students with disability, specialist researchers, and managers. The main results shows that is not enough to focus on the principal subjects of inclusive education, instead, it’s necessary to analyze responsibilities of every actor involved in the inclusion process, motivation based structure is needed towards a cultural change. Otherwise, attitudinal barriers of the university community continue to be one of the principal limits for these students. Spinoza distinguishes two orders of knowledge: an order conceived by the intellect, that is, the necessary order of nature and another order conceived by the imagination, that is, the common order of nature in which the contingent and the possible dwell. However, the common order is not only a deprivation of knowledge, but also a reality for the finite mode. Because we cannot exclude the existence of the common order, this paper attempts to understand how we can reconcile it with (...) the necessary order. Spinoza’s critique of imagination is that it introduces fragmentation and discontinuity into nature, since it is a kind of knowledge that does not realize the basis of this continuity: the necessary order. Through an analysis of time as a product of imagination, we will try to show how it introduces the idea of contingency and consequently that of possible. Just as time, the common order can be grasped by reason as an outer frame, it will no longer be an obstacle to the necessary chain of things in the necessary order. It is through the necessary order that we can realize the necessity that underlies the production of time, possible, and contingency as the corruptibility of all particular things. (shrink)

Este trabajo comienza ofreciendo, a modo de «status quaestionis», una panorámica de la atención que se ha prestado a la obra ensayística de Sánchez Ferlosio, desde las lecturas propuestas en los años noventa del siglo pasado por autores del círculo de nuestro autor hasta los estudios y artículos aparecidos tras su muerte, en 2019. A continuación, se presentan algunas aportaciones relevantes de Ferlosio al pensamiento contemporáneo. Concretamente, se analiza el «aprecio por lo perecedero» como uno de estas aportaciones y, además, (...) se explica cómo este aprecio surge en el marco de una «actitud reflexiva ante el lenguaje». Por último, se procede a un balance crítico de las posiciones de Sánchez Ferlosio con respecto a los asuntos mencionados. (shrink)

This fine collection of essays by a leading philosopher of science presents a defence of integrative pluralism as the best description for the complexity of scientific inquiry today. The tendency of some scientists to unify science by reducing all theories to a few fundamental laws of the most basic particles that populate our universe is ill-suited to the biological sciences, which study multi-component, multi-level, evolved complex systems. Drawing on everyday telephone and video interactions, this book surveys how English speakers use grammar to formulate responses in ordinary conversation. The authors show that speakers build their responses in a variety of ways: the responses can be longer or shorter, repetitive or not, and can be uttered with different intonational 'melodies'. Focusing on four sequence types: responses to questions, responses to informings, responses to assessments, and responses to requests, they argue that an interactional approach holds the key to explaining (...) why some types of utterances in English conversation seem to have something 'missing' and others seem overly wordy. ABSTRACT Recently, children’s books have used augmented reality as a resource, being called 4D books. Augmented reality allows the user to see through the world while interacting in real-time with images produced digitally, resulting in interactivity. The present study aims to introduce the results of a brief reflection on the illustrated book O reino encantado do pôneis 4D under the approach of the semiotics of culture, departing from the notion of semiosis and semiosphere. The semiosphere, drawn by Lotman (1990), in (...) analogy with the biosphere, can help understand the topology of the real and virtual worlds, referred to as the real subsemiosphere and virtual subsemiosphere, located in the interior of the broader semiosphere of the Brazilian culture. Nous proposons dans ce volume une approche pluridisciplinaire du sens commun. Fruit d'un travail collectif organisé au CURAPP et dans le cadre du programme scientifique ASC, les articles ici présentés, par la diversité de leurs orientations théoriques et disciplinaires, contribuent à faire un état des lieux de la question. L'idée de sens commun est fréquemment utilisée et citée en sociologie, philosophie, linguistique, psychologie, sans qu'il en soit toujours proposé de définition ou d'analyse critique. Elle demandait un travail de définition et (...) de requalification historique et théorique, et de mise en rapport à des corrélats : la norme, le sens moral, le sens social, le sens critique. L'ouvrage vise donc la description, aussi précise que possible des formes et des normes du sens commun en tant qu'elles enveloppent des dimensions cognitives, perceptives, linguistiques, sociales et morales. Il apparaît vite que cette notion résiste à la simple analyse et que seule la superposition de différents points de vue permet d'en percevoir quelques contours. On ne sera pas étonné de la diversité des figures convoquées et de la variété des objets à partir desquels elle est manifestée et interprétée. L'intérêt du sens commun comme objet d'investigation philosophique est alors d'apparaître comme ce qui permet de reprendre de manière oblique certains questionnements classiques qu'il déplace. Ainsi de la question topique des formes affectives, linguistiques et sociales d'expression du sentiment, de l'ancrage de la moralité dans une nature humaine et dans une sensibilité partagée ou encore de la manière dont le sens commun permet de réinterpréter, dans l'histoire des sciences sociales, la question des liens entre action et critique. O objetivo deste artigo é analisar o conteúdo das Cartas 34, 35 e 36 da Correspondência de Espinosa a Hudde. Nele podemos perceber o esforço e engenhosidade do filósofo em conduzir o seu interlocutor a assentir à primeira definição da Ética, a definição de causa sui. Hudde, matemático de formação, se esforça em compreender como o filósofo pode demonstrar que a unicidade de Deus possa ser deduzida exclusivamente do fato de que sua natureza ou essência envolve existência necessária. É através (...) do estatuto causal da definição verdadeira que Espinosa poderá conduzi-lo, e evitar, assim, que caia nos paradoxos do uno e do múltiplo, da distinção real e da numérica. Dada a incapacidade do matemático em assentir à definição genética de Deus, o filósofo o conduzirá a assentir indiretamente à definição através do procedimento de demonstração negativa ou por redução ao absurdo. Esse movimento intelectual explicitará os propria de Deus: a eternidade, a simplicidade, a infinitude, a indivisibilidade, a perfeição e a unicidade. (shrink)

O objetivo desse artigo é explicitar, na medida do possível, as críticas formuladas por Espinosa em relação a Descartes, notadamente em sua doutrina do livre-arbítrio. As críticas são fundamentadas nas proposições 48 e 49 da parte II da Ética, além das objeções que a complementam. Essa análise se deterá especialmente na identificação que Espinosa realiza entre ideia e volição, sendo a ideia concebida como um ato de afirmação ou negação, de modo que a volição é constitutiva da ideia. Com essa (...) análise, tentaremos evidenciar que a identidade entre ideia e volição não elimina o caráter voluntário da ação cognitiva do homem na filosofia espinosana. A crítica de Espinosa em relação ao conceito de vontade, entendida como uma faculdade abstrata, isto é um universal abstrato, visa a romper com a ideia de que a vontade é absolutamente livre. A vontade deixa de ser a faculdade que afirma a liberdade entre contrários e torna-se a afirmação da livre necessidade. É essa concepção de uma faculdade universal e abstrata que acarretará ilusão do livre-arbítrio. (shrink)

By the start of the twenty-first century, the notion of ‘the sublime’ had come to seem incoherent. In the last ten years or so considerable light has been shed by empirical psychologists on a related notion of ‘awe’, and a fruitful dialogue between aestheticians and empirical psychologists has ensued. It is the aim of this paper to synthesize these advances and to offer what I call a ‘two-tiered’ theory of the sublime that shows it to be a coherent aesthetic category. (...) On this theory, sublime experiences begin in an ‘awe response’ (the ‘thin sublime’) and might, with the additional element of temporally-extended reflection, turn into a ‘thick sublime’ response. Building on accounts of the sublime as a species of ‘aesthetic awe’ (Clewis, 2019a and 2019b; Arcangeli, et al., 2020) I aim to show that this two-tiered theory helps to explain why sublime experiences seem to have a basic, primordial core, but also seem to be historically and culturally quite variable (as Nicolson, 1963 [1959]; Battersby, 2007; and McMahon, 2017 have stressed). On this model, the cultural and historical variability comes in largely at the point of the temporally-extended reflection characteristic of the thick sublime, due to the cognitive stock that the subject brings to the encounter. Thus, sublime experiences really lend themselves to being interpreted quite variously by the subject (as well as by the theorist) of these experiences, as, for example, affording insight into the Divine, our moral vocation, or our metaphysical unity with the entire universe, among other lofty thoughts.
